1. State v. James Lanza, 33, of Bayville – (Possession of Child Pornography 4th degree; Procurement of Child Pornography 2nd degree) case is from May 21, 2012 and stemmed from an online investigation into Child Pornography.
2. State v. Steven Wagner, 25, of Point Pleasant Boro – (Possession of Child Pornography 4th degree) case is from March 19, 2012 and stemmed from an online investigation into Child Pornography.
3. State v. Erica Capasso, 27, of Howell – (Invasion of Privacy 3rd degree; Bias Intimidation 4th degree; Contempt 4th degree) this case involves the defendant creating a fictitious Facebook page and posting inappropriate photographs of the victim along with racial slurs.
4. State v. Jeana Ganun, 35, of South Toms River – (Endangering the Welfare of a Child 2nd degree; Invasion of Privacy 3rd degree; False Incrimination 3rd degree) this case is from December 17, 2012 in South Toms River. Ms. Ganun took inappropriate photographs of a juvenile victim and alleged her husband took the photos with the purpose of falsely incriminating him.

 

The media and the public are reminded that criminal charges are merely accusations and that these defendants are presumed innocent until proven guilty.

Ocean County Prosecutor Joseph D. Coronato announced today that the Ocean County Grand Jury has returned an 18 count indictment against Bruce Roslin, 44, of 16 Snead Court, Little Egg Harbor and Jonathan Dockery, 32, of 866 Railroad Drive, Little Egg Harbor.  The indictment results from an investigation led by the New Jersey State Police into the fire that started on and destroyed Roslin’s 26 foot 2007 ProKat on September 19, 2009 while it was docked at the Tuckerton Marine Service Center on South Green Street in Tuckerton.  The fire damaged the marina and several other boats that were docked nearby.  Roslin subsequently applied for and received insurance proceeds in excess of $100,000 for the destruction of his boat.

Roslin is charged with arson for hire, a first degree crime, for offering money to Dockery to light Roslin’s boat on fire for the purpose of destroying it.  Dockery is also charged with arson for hire for agreeing to accept money to commit the aggravated arson to the boat.  Roslin and Dockery are also charged with second degree arson, conspiracy to commit aggravated arson and ten (10) counts of third degree arson for the damage caused to the marina and the nearby vessels caused by the intentionally set fire to Roslin’s boat.  Arson for hire is a first degree crime which carries a maximum penalty of up to 20 years in New Jersey State Prison.  Aggravated Arson is a second degree crime which is punishable by up to 10 years incarceration.  Arson is a third degree crime punishable by up to 5 years incarceration.

Roslin is also charged with: Insurance Fraud, a third degree crime, for making a fraudulent insurance claim; False Swearing, a fourth degree crime, for making false statements on his “Sworn Statement in Proof of Loss” to the Travelers Insurance Company; Theft by Deception, a third degree crime, for unlawfully accepting the insurance money  after he had arranged to destroy his boat by fire; and Witness Tampering, a third degree crime.

Roslin was arrested yesterday on the strength of an indictment warrant.  His bail was set at $150,000 no 10% by the Honorable Francis R. Hodgson, Jr., J.S.C.  Dockery was released on his own recognizance.

The investigation was conducted by Detective William Simonson and Sgt. Adam Graczyk of the New Jersey State Police.  Anyone with information concerning this case is asked to call either one of these investigators at the Tuckerton State Police Barracks at (609) 296-3132.

David Rozo-Brinez, 24, of Toms River was indicted for five counts of second degree Distribution of Child Pornography in Toms River on 2/23/13, 3/6/13, 3/11/13, 3/16/13, and 3/25/13. The indictment also included one count of fourth degree Possession of Child Pornography in Toms River between 2/23/13 and 3/25/13.

Brian Derr, 52, of Eagleswood Township was indicted for one count of fourth degree Stalking in Stafford from 2/26/12 to 7/8/13. Derr faces up to 18 months on the Stalking charge.

Eric L. Underwald, 28, of Barnegat was indicted for one count of second degree Distribution of Child Pornography in Barnegat between the dates of 5/12/13 and 7/28/13. The indictment also included one count of fourth degree Possession of Child Pornography in Barnegat on 8/1/13and one count of fourth degree Resisting Arrest in Barnegat on 8/1/13. Underwald also faces up to 18 months on the Resisting charge after being restrained from jumping out of a second story window.

Christopher J. Pontrelli, 28, of Toms River was indicted for five counts of second degree Distribution of Child Pornography in Toms River – three counts on 4/15/13, one count on 4/16/13, and one count on 4/17/13. The indictment also included six counts of fourth degree Possession of Child Pornography in Toms River – three counts on 4/15/13, one count on 4/16/13, one count on 4/17/13, and one count on 5/15/13.

The three Child Pornography indictments all pre-date the passage of the enhanced Child Pornography laws, which Governor Christie signed into law on August 14, 2013. They face 5-10 years on the second degree charges, with a Megan’s Law posting, and up to 18 months on the Possession charges. All four indictments were returned on September 9, 2014.
