High Tech Crime Unit Cases Result in Indictments

David Rozo-Brinez, 24, of Toms River was indicted for five counts of second degree Distribution of Child Pornography in Toms River on 2/23/13, 3/6/13, 3/11/13, 3/16/13, and 3/25/13. The indictment also included one count of fourth degree Possession of Child Pornography in Toms River between 2/23/13 and 3/25/13.

Brian Derr, 52, of Eagleswood Township was indicted for one count of fourth degree Stalking in Stafford from 2/26/12 to 7/8/13. Derr faces up to 18 months on the Stalking charge.

Eric L. Underwald, 28, of Barnegat was indicted for one count of second degree Distribution of Child Pornography in Barnegat between the dates of 5/12/13 and 7/28/13. The indictment also included one count of fourth degree Possession of Child Pornography in Barnegat on 8/1/13and one count of fourth degree Resisting Arrest in Barnegat on 8/1/13. Underwald also faces up to 18 months on the Resisting charge after being restrained from jumping out of a second story window.

Christopher J. Pontrelli, 28, of Toms River was indicted for five counts of second degree Distribution of Child Pornography in Toms River – three counts on 4/15/13, one count on 4/16/13, and one count on 4/17/13. The indictment also included six counts of fourth degree Possession of Child Pornography in Toms River – three counts on 4/15/13, one count on 4/16/13, one count on 4/17/13, and one count on 5/15/13.

The three Child Pornography indictments all pre-date the passage of the enhanced Child Pornography laws, which Governor Christie signed into law on August 14, 2013. They face 5-10 years on the second degree charges, with a Megan’s Law posting, and up to 18 months on the Possession charges. All four indictments were returned on September 9, 2014.
