SENTENCING IN PLUMSTED AGGRAVATED SEXUAL ASSAULT

Anistides Vigil, 48, of New Egypt, NJ, was sentenced today on a 1st degree Aggravated Sexual Assault charge. The Court imposed a custodial term of 12 years, which requires the defendant to serve at least 10 years and 2 months before he can become eligible for parole, Megan’s Law Registration, Parole Supervision for Life and Nicole’s Law (No Contact with Victim). Vigil was found not to be repetitive and compulsive after he submitted to an “AVENEL” evaluation. Defendant also has an ICE detainer.

The sentencing was the result of a guilty plea entered by Vigil before Judge James M. Blaney, J.S.C. on June 27, 2014. The Ocean County Prosecutor’s Office requested 15 years in New Jersey State Prison, subject to the No Early Release Act, Megan’s law, Nicole’s Law (No Contact with Victim) and Parole Supervision for Life. The defense argued for 10 years in New Jersey State Prison.

The underlying incident involved the defendant having committed acts of sexual abuse on the 9 year old victim in July of 2013 in Plumsted Township.  Vigil was arrested on July 31, 2013.

The case was investigated by OCPO Special Victims Unit Detective Melissa Matthews.  Senior Assistant Prosecutor Terry Ann Linardakis prosecuted the case.
