GUILTY VERDICT IN SEX ASSAULT CASE

On June 20, 2018 a jury returned a verdict of guilty to one count of 2nd degree Sexual Assault against Alan D. Harbatuk, 71, formerly of Hillsborough, NJ.  Harbatuk was convicted of engaging in sexual relations with a 15 year old in 2003 both in Barnegat at the Citta Boy Scout camp and in Hillsborough Township Somerset County where Harbatuk resided at the time.

Immediately following the verdict, Harbatuk was remanded to the Ocean County Jail pending sentencing which will be scheduled once an Avenel evaluation is completed.  Harbatuk faces 5-10 years in New Jersey State Prison with Megan’s Law required registration and Parole Supervision for Life.

Harbatuk was arrested on October 23, 2014 by the Somerset County Prosecutors Office.  His charges stem from conduct in Hillsborough Township as well as Barnegat Township.  The case was subsequently transferred to the Ocean County Prosecutor’s Office to be prosecuted together with co-defendant Raymond Waters.  Raymond Waters was charged with Aggravated Sexual Assault and Sexual Assault for engaging in sexual relations with the same victim while a teacher at Toms River North High School.  Waters’ trial will be held at a future date.  The case indictment filed on April 2, 2015 is attached.

The case was tried by Senior Assistant Prosecutor Kristin L. Pressman before the Honorable Therese A. Cunningham, J.S.C.  The case was investigated by Sgt. Jason Steele of the Ocean County Prosecutors Office, Somerset County Prosecutors Office Detective Justin Berger, Hillsborough Police Department Detective Robert Meszaros, as well as, Detective Tom Grosse and retired Detective Alex Scherer of the Toms River Police Department.
